Court Discharges 52-year-old Man Accused Of Attempt To Have Carnal Knowledge With Another Man

Magistrate Court sitting in Ogbeson, Benin in Edo State on Friday discharged 52-year-ol, Mike Aibueku, who was accused of attempting to have carnal knowledge of another man.



The Chief Magistrate of Ogbeson,
Prince Mutairu Oare dismissed the charge after the Police Prosecutor, Inspector Charity Asemota's requested to withdraw the charge against the Defendant,
Mike Aibueku.

In his ruling, the Chief Magistrate held that he discharged the Defendant of the two count charge bordering on homosexual on the ground that the case was not on merit.

At the hearing of the case on Friday, the Police Prosecutor, Inspector Charity Asemota urged the Magistrate Court to dismiss the case, adding that the complainant, Omele Friday, had applied to withdraw his charge against the Defendant.


Giving his reason for withdrawing his charge, the Complainant, Omele Friday, told the court that he doesn't want to continue with the charge against the Defendant because he is a family member, adding they have settled the case.

The Prosecutor had earlier arraigned the Defendant on two count charge on what he described as unnatural offence having conducted himself in as manner likely to cause breach of peace.

The Prosecutor, Asemota had alleged that the Defendant, Mike Aibueku, attempted to have carnal knowledge of the complainant,
Omele Friday, on June 2, 2020, along Benin Agbor Road, Benin in Edo State, adding that the Defendant gave his breast to the complainant to suck which breached the peace of the complainant.

The first and second count charge which would have attracted seven years imprisonment and one month respectively was however, withdrawn after the Prosecutor disclosed that the complainant had settled with the Defendant as a family member.
