Against the People's Will, Tribunal Rules in Favour of Oseni

Justice A.O. Chijioke of  Kogi State election petition Tribunal, on Friday, ruled in favour of Yakubu Oseni of APC.



In his ruling, Justice A.O. Chijioke held that, examining the star evidence of the start witnesses of Natasha Akpoti, the Tribunal held that, "in the case of pastor Iyanu and others against INEC, on the onus of seeking for nullifying an election, where a petitioner in an election alleged non compliance of electoral laws,  the petitioner need to present polling units agents to prove the non compliance and eye witnesses who were present at the process of entering the documents.

"The Appeal Court held that when document is tendered as evidence and the petitioners are not the owner of the documents and were not present at the making of such documents, such evidence can only be tendered and admitted as hearsay.

"The 22 witnesses tendered, unfortunately were ward agents, therefore the votes accorded to Yakubu Oseni remain intact and the petition is therefore struck out for lack of merit

"On the ground that Yakubu Oseni was not qualified to contest for 2019 Kogi Central senatorial election, the Tribunal held that the failure to state the petitioners' address of service and occupier  is not a mere procedural proceedings and the petition is therefore strike out for lack of incompetent."

Senator Ahmed Ogembe's case was also struck out for what the Tribunal termed lack of merit.
